Don’t forget to “like” us on Facebook (Search: SCW Tobacco Free Coalition) At 9:30 am April 10 (today), the U.S. Court of Appeals for the D.C. Circuit will hear oral arguments on lifting a federal judge’s order blocking the large, graphic cigarette warning labels required under the 2009 law giving the Food and Drug Administration authority over tobacco products. The case consolidates appeals of Judge Richard Leon’s two decisions to block the FDA from implementing the new warnings, which under the law are supposed to begin appearing on cigarette packs and advertisements in September. The lawsuit was brought by tobacco companies that oppose the warning labels. Judge Leon’s ruling that the warnings violate the First Amendment is wrong on the law and wrong on the science, as this memo will outline. Ruling in a separate case on March 19, the U.S. Court of Appeals for the Sixth Circuit upheld the warning label requirement as constitutional. That court, upholding a lower court ruling, held that the warnings are consistent with the First Amendment under established precedent permitting regulation of commercial speech. Specifically, the Sixth Circuit found that the Supreme Court has repeatedly upheld the required disclosure of factual information to consumers if it is “reasonably related” to a government interest. The court ruled that the cigarette warnings advance the government’s interest in preventing consumer deception and promoting greater understanding of tobacco-related health risks.
